{"id":750,"date":"2020-11-17T19:33:53","date_gmt":"2020-11-17T19:33:53","guid":{"rendered":"https:\/\/brownsvillenews.org\/the-drug-testing-of-black-and-hispanic-mothers-offers-more-evidence-of-racial-bias-in-nyc-healthcare\/"},"modified":"2020-11-17T19:33:53","modified_gmt":"2020-11-17T19:33:53","slug":"the-drug-testing-of-black-and-hispanic-mothers-offers-more-evidence-of-racial-bias-in-nyc-healthcare","status":"publish","type":"post","link":"https:\/\/brownsvillenews.org\/?p=750","title":{"rendered":"The Drug Testing of Black and Hispanic Mothers Offers More Evidence of Racial Bias in NYC Healthcare"},"content":{"rendered":"<p><em><strong>by Cheryl Smith for <a href=\"https:\/\/healthynyc.com\/\">HealthyNYC.com<\/a><\/strong><\/em><\/p>\n<p><span style=\"font-weight: 400;\">In 2019, a woman of color attended a New York City Council meeting to <\/span><a href=\"https:\/\/www.wnyc.org\/story\/reduce-bias-nyc-public-hospitals-changing-how-it-screens-pregnant-women-drug-use\/\"><span style=\"font-weight: 400;\">discuss<\/span><\/a><span style=\"font-weight: 400;\"> her experience of an all-too-common and disturbing problem that many new Black and Hispanic mothers face.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During her stay at a New York City Public hospital, she was screened for drugs without her consent after she admitted to smoking marijuana to deal with nausea caused by pregnancy. A medical professional then reported her to New York City&#8217;s Administration for Child Services.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This occurrence happens a lot. Black and Hispanic women who have just given birth to children are typically subjected to drug screenings at higher rates than their white counterparts. However, the frequency of drug use between all three groups <\/span><a href=\"https:\/\/www.nbcnewyork.com\/news\/local\/nyc-to-investigate-top-hospitals-over-possible-racial-bias-in-drug-testing\/2726563\/\"><span style=\"font-weight: 400;\">is reported to be similar<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h3><b>Policy Changes and Commissions Look to Address The Issue<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In January of this year, in response to the women&#8217;s story at the New York City Council, the New York City Health and Hospitals Corporation <\/span><a href=\"https:\/\/www.wnyc.org\/story\/reduce-bias-nyc-public-hospitals-changing-how-it-screens-pregnant-women-drug-use\/\"><span style=\"font-weight: 400;\">worked on a policy <\/span><\/a><span style=\"font-weight: 400;\">to institute some changes to how the City&#8217;s public hospitals screen pregnant women.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The changes included the intention to screen all women with a simple questionnaire only for health purposes. However, it looks as if this plan has fallen through the cracks.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On November 16, 2020, the New York City Commission on Human Rights <\/span><a href=\"https:\/\/www.nbcnewyork.com\/news\/local\/nyc-to-investigate-top-hospitals-over-possible-racial-bias-in-drug-testing\/2726563\/\"><span style=\"font-weight: 400;\">began an investigation<\/span><\/a><span style=\"font-weight: 400;\"> into how Montefiore, Mount Sinai, and New York-Presbyterian Hospitals were reporting Black and Hispanic families to the State Central Register of Child Abuse and Mistreatment (SCR). These reports occurred after a single unconfirmed positive toxicology test.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Advocates have expressed concern about this process&#8217;s racial disparity, as these families are often subjected to child protection investigations by the SCR.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This development is just another instance in a long line of implicit bias and racial discrimination found in New York City&#8217;s healthcare and child welfare practices.<\/span><\/p>\n<h3><b>A Troubling History of Implicit Bias in Drug Testing<\/b><\/h3>\n<p><a href=\"https:\/\/static1.squarespace.com\/static\/5be5ed0fd274cb7c8a5d0cba\/t\/5eead939ca509d4e36a89277\/1592449422870\/MFP+Drug+War+Foster+System+Report.pdf\"><span style=\"font-weight: 400;\">A report<\/span><\/a><span style=\"font-weight: 400;\"> by the Movement for Family Power, which was also co-published by the NYU Family Defense Clinic and the Drug Policy Alliance, took an in-depth look at the child welfare disparities in New York, specifically the Bronx.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The report found that the &#8220;overwhelming majority of parents who are accused of abusing and neglecting their children are low-income, Black, Latinx, and disproportionally mothers.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yet, white and higher-income parents were found to use drugs at similar rates, but New York City&#8217;s Administration for Child Services rarely investigated these people.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The report also found that medical care providers were testing minority mothers without their consent and giving the information\u2014including tests and details of conversations about drug use\u2014 to child protective agents. This report confirms much of what advocates have noticed about the current state of child welfare in New York City.\u00a0<\/span><\/p>\n<h3><b>Black Mothers Face Other Disturbing Health-Related Hurdles<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Disproportionate drug testing is more evidence of the ongoing problem of racial discrimination in the healthcare system. However, besides this issue, New York City public hospitals have fallen short in preventing Black mother&#8217;s deaths during childbirth\u2014as Black women are <\/span><a href=\"https:\/\/www1.nyc.gov\/office-of-the-mayor\/news\/365-18\/de-blasio-administration-launches-comprehensive-plan-reduce-maternal-deaths-life-threatening\"><span style=\"font-weight: 400;\">eight times<\/span><\/a><span style=\"font-weight: 400;\"> more likely to die due to childbirth complications in New York City.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This year, the heart-wrenching deaths of women like <\/span><a href=\"https:\/\/www.rollingstone.com\/culture\/culture-features\/shaasia-washington-death-woodhull-hospital-black-maternal-mortality-rate-1026069\/\"><span style=\"font-weight: 400;\">Sha-Asia Washington<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/may\/02\/amber-rose-isaac-new-york-childbirth-death\"><span style=\"font-weight: 400;\">Amber Rose Isaac<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/wired868.com\/2020\/03\/13\/a-unique-light-gone-too-soon-remembering-cordielle-street\/\"><span style=\"font-weight: 400;\">Cordielle Street<\/span><\/a><span style=\"font-weight: 400;\"> during childbirth, has continued the narrative that many medical professionals do not provide the same empathy and duty of care to Black mothers as they do to white ones.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And, the children of Black mothers often don&#8217;t fare too much better. A recent examination into national data found that Black children <\/span><a href=\"https:\/\/www.nbcnewyork.com\/news\/local\/black-kids-die-more-often-after-surgery-new-research-shows\/2521362\/\"><span style=\"font-weight: 400;\">were more likely <\/span><\/a><span style=\"font-weight: 400;\">to die after common surgeries than their white counterparts.\u00a0<\/span><\/p>\n<h3><b>Proposed Solutions Continue to Fall Short\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In a country as economically developed as the United States, it&#8217;s hard to accept that these health and child welfare disparities continue to be a significant problem.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nevertheless, unfortunately, racism continues to creep into various systems within this country: whether it be financial, medical, legal, or educational. These instances show that Black and Hispanic people continue to pay a heavy price for the racial biases that permeate crucial systems and processes.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2018, the City planned to <\/span><a href=\"https:\/\/www1.nyc.gov\/office-of-the-mayor\/news\/365-18\/de-blasio-administration-launches-comprehensive-plan-reduce-maternal-deaths-life-threatening\"><span style=\"font-weight: 400;\">invest $12.8 million<\/span><\/a><span style=\"font-weight: 400;\"> to address the rising mortality rates among women of color. Nonetheless, in year two, the funding doesn&#8217;t seem to have come close to solving the problem.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many of the plans to address these issues seem to fall short, and as they do, more Black and Hispanic families are dealing with the consequences\u2014through no fault of their own.
